1. The service

Embi Media provides online advertising optimization and monetization services across the advertiser's advertising inventory, on websites, applications and mobile devices connected to the internet.

Embi Media creates an auction for each advertising impression from the advertiser's inventory, where bids are derived from multiple sources, including media buying programs from our Demand Partners.

2. Acceptable use

By accessing the Dominus platform, you warrant that you will use the service in compliance with applicable law and these terms.

You will not attempt to access the platform without authorization or bypass access controls.
You will not interfere with the operation of the service or with traffic verification.
You will not use the platform to distribute illegal content or content that infringes third-party rights.
You will not attempt to use data obtained through Google APIs for purposes prohibited by Google policies, including the generation or distribution of AI NCII.

3. Warranties and liability

Each party represents and warrants to the other that it has the rights and authority necessary to enter into and perform these terms.

To the maximum extent permitted by applicable law, Embi Media is not liable for lost profits, lost revenue or indirect damages arising from use of the service.

4. Intellectual property

Embi Media retains all rights in its platform, code, trademarks and header bidding technology. These terms grant no license to that property beyond the usage rights strictly required to operate the service.

5. Data and third parties

The processing of personal data is governed by our Privacy Policy, which forms part of these terms.

Use of Google APIs is governed by the Google APIs Terms of Service and the Google API Services User Data Policy.

6. Termination

Either party may end the commercial relationship with prior notice. On termination, your access to the platform ceases and data is deleted in accordance with our Privacy Policy.

7. Governing law

These terms are governed by the laws of the jurisdiction where the commercial relationship is established. Any dispute will be submitted to the competent courts of that jurisdiction.
